NOTICE is hereby given that there will be a Public Hearing of the Bellechester City Council at the Bellechester Community Center, Bellechester, MN, at their regular meeting on December 18, 2024 at 6:00 for the purpose of consideration of the Pool and Spa Ordinance #36.

Any and all person(s) desiring to be heard shall be given an opportunity at the above stated time and place.  Text of the Pool and Spa Ordinance in consideration can be found below.

Pool and Spa Ordinance

Ordinance No. 36

Private outdoor residential pools, both above and below ground that exceeds 2’ depth must have a building permit, and hot tubs are permitted as an accessory use, within the rear yard or non-required side yard setback; except that, for multiple-family dwelling. Private outdoor pools and hot tubs shall meet the following requirements. 

  • There shall be a distance of not less than ten (10) feet between the adjoining property line and the outside of the pool wall for above ground pools and in-ground pools.
  • There shall be a distance of not less than four (4) feet between the outside pool wall and any building located on the same lot.
  • No swimming pools shall be located less than ten (10) feet from any street or alley right of way, or the distance required for side yard by the zoning code, whichever is greater.
  • No Swimming pool shall be located in a public easement.
  • All properties containing swimming pools shall be completely enclosed by a either a pool or yard fence not less than five (5) feet in height. The gates shall be of a self-closing and self-latching type, with the latch on the inside of the gate, not readily available for children to open. Gates shall be capable of being securely locked when the pool is not in use.
  • All yards containing hot tubs shall be secured by a cover which shall be locked when the hot tub is not in use.
  • A site plan, builder plan, and construction plan shall be submitted for lot review to the city prior to commence of construction.
  • All draining of pools or hot tubs shall be directed to the street, not to the rear or side lot of the property.
  • Proof of pool coverage must be on homeowners or renters insurance.
